Participation Terms and Conditions
All participants in Relay For Life must accept these terms and conditions (“Terms and Conditions”) prior to their participation in Relay For Life. If you are under the age of 18, you must ensure that these Terms and Conditions are accepted by your parent or guardian on your behalf. By participating in the event you are also accepting the Fundraising Guidelines that apply in the State or Territory in which you are conducting your fundraising event; the Privacy Collection Statement; and any other documents provided to you in your welcome pack, and you agree to comply with them. Where relevant these Terms and Conditions will also apply to spectators and visitors at Relay For Life events and to donors and supporters of participants.
Definitions and Interpretation
“Relay For Life” includes not only the Relay For Life event, but all other activities relating to Relay For Life, whether occurring before, during or after the Relay For Life event, and whether organised by Cancer Council or any other person.
“Cancer Council”, “we”, “us” or “our” means the Cancer Council in the State or Territory in which you are participating in Relay For Life. Full details of Cancer Council Australia’s State and Territory members are available here: https://www.cancer.org.au/about-us/about-cancer-council.
“You” means all adult participants, all Youth Participants and any parent or guardian accepting these Terms and Conditions on behalf of a Youth Participant.
“Youth Participants” means participants under the age of 18.
If any of part of these Terms and Conditions is unenforceable, illegal or void, then you agree that that part must be read down the minimum necessary to allow it to be enforceable whilst preserving as close as is possible the purpose of that part. If that part cannot be read down, it is severed, and the rest of these Terms and Conditions remain in force.
Risk Notice and Voluntary Assumption of Risk
You understand and agree that you participate in Relay For Life at your own risk.
Relay For Life is an event that involves the inherent risks of harm associated with physical exertion. Some of those risks include injury due to slippery or uneven surfaces, obstacles, trip hazards, overcrowding, collision with objects or people and the effects of heat, cold, dehydration and exhaustion. In rainy, windy or other inclement weather conditions, tents, marquees or other structures may collapse or become unsecured from the ground, potentially resulting in injury. Further risks may be associated with parts of Relay For Life that may occur at night.
The above is not an exhaustive list of all risks inherent in your participation in Relay For Life. There may be risks that are not known or reasonably foreseeable at this time.
Cancer Council recommends that you consult a doctor before participating in Relay For Life, particularly if you have ever experienced a heart condition, stroke, unexplained chest pains, faintness, dizziness, shortness of breath, severe asthma, diabetes, muscle, joint or bone problems or any other medical conditions that may make it dangerous for you to participate in Relay For Life. Regardless of whether you have consulted a doctor, you agree that you are aware of the risks involved and you voluntarily assume those risks (including any arising from the negligence of Cancer Council).
You warrant that you have no known medical conditions or disabilities that may be incompatible with your safe participation in Relay For Life. You warrant that you are in proper physical and mental condition to participate in Relay For Life. You consent to medical care and transportation in order to obtain treatment in the event of injury to your during the event, as volunteers or medical professionals may deem appropriate. You understand that these Terms and Conditions extend to full release and exclusion for any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury to me.
You understand that Cancer Council has obtained no personal accident insurance or any other insurance covering your participation in Relay For Life and it is your responsibility to obtain any and all insurance which is appropriate for that purpose.
You acknowledge that during Relay For Life both your person and your property shall be at your own risk. You understand and accept that the organisers and Cancer Council are not responsible for any loss or damage to personal belongings and that vehicles are parked at the owner’s own risk.
You understand that Cancer Council will not supervise Youth Participants and that Youth Participants must arrange to be supervised by an adult.
Indemnity
You will indemnify, keep indemnified and hold harmless Cancer Council and all Relay For Life sponsors and organisers, as well as their officers, employees, volunteers, agents and representatives, from any and all loss, damage, cost or expense in connection any claim arising from your participation in or involvement with Relay For Life or any breach of these Terms and Conditions by you; and publication or supply of any materials (as defined in the Media Consent and Provision of Materials clause below) by you.
Release and Exclusion of Cancer Council's Liability
To the maximum extent permitted by law:
- you fully and irrevocably exclude and release Cancer Council and all Relay For Life sponsors and organisers, as well as their directors, officers, employees, volunteers, agents and representatives, from all liability for any loss, damage, cost or expense (whether in negligence, contract, under statute or otherwise) suffered by you as a consequence of my involvement in Relay For Life, including in relation to death and personal injury;
- all conditions, warranties, guarantees, rights, remedies, liabilities or other terms implied or conferred by statute, custom, or the general law that impose any liability or obligation on Cancer Council or Relay For Life sponsors or organisers (or their directors, officers, employees, volunteers, agents and representatives) are excluded (including consumer guarantees to the extent such exclusions are permitted under the law);
- neither Cancer Council nor any Relay For Life sponsor or organiser (nor any of their directors, officers, employees, volunteers, agents and representatives) will be liable to you, or any other person in contract, tort (including negligence) or otherwise for any loss, damage, cost or expense of any kind (including direct, indirect or consequential losses, damages, costs and expenses) suffered or incurred by you, or any other person in connection with Relay For Life; and
- in any circumstances where the above exclusions (or any of them) are held by a court to be ineffective or unenforceable for any reason whatsoever, Cancer Council's liability to you and to any other person is limited (at its option) to resupplying, repairing or replacing the service to you or the payment of the cost of supplying the service to you again.
Refunds Policy
Registration payments and sponsorships of participants are not refundable for any reason. If you are unable or unwilling to participate in Relay For Life, or if the Relay For Life is modified or terminated for any reason, registration payments will be deemed to be donations to Cancer Council for which a tax-deductible receipt will be issued upon request. However, Cancer Council is willing to consider requests to transfer registration fees to future events on a case-by-case basis. Should you have made an error whilst registering or donating or wish to request a transfer to a future event please contact your local Cancer Council office for assistance.
Public Venue and Persons Giving Directions
Relay For Life is a public event held on premises or property made available for community events. As such, the agreement to participate means that you also agree to be bound by the rules and regulations that may apply to the premises or property where the Relay For Life is to be held. You also agree to follow the directions of anyone authorised to give directions whilst you are on the said premises or property. This includes directions not to participate, or to leave the premises or property where Relay For Life is held.
Behaviour
You agree to show respect and consideration for other participants in the event. You agree to abide by the venue rules concerning activities, coarse language, privacy, and noise. You acknowledge and agree that Relay For Life is a non-smoking event. You must obey all applicable laws at all time while participating in Relay For Life.
You also agree that you will abide by the decision of the local organisers of Relay For Life about whether alcohol is permitted to be consumed at the venue. You also agree that if alcohol is permitted, that you will not cause, permit or allow any such alcohol to be supplied to any minor. You acknowledge that Relay For Life is an animal free event, except for animals that are companions for people with visual impairments.
You acknowledge that Relay For Life is an event that may involve minors. You warrant that you/ are not a person recorded on the Australian National Child Offender Register.
Media Consent and Provision of Materials
You acknowledge that in the course of Relay For Life, photographs, images, film or audio recordings may be taken of you, either alone or with others. If you post photographs, images, film, audio recordings, text or artwork (“materials”) on social media, share that content with Cancer Council using hashtags or tag Cancer Council in the post, or otherwise provide any materials to Cancer Council, you will ensure that:
- you own the intellectual property in those materials or have the permission of the owner of the intellectual property for Cancer Council (and its assignees and licensees) to use such items;
- the material is not defamatory or a malicious falsehood in relation to any product, service, person or corporation;
- the material is not a ‘passing off’ of any product or service and does not constitute unfair competition;
- the material does not infringe any intellectual property right including, but not limited to, trademarks, service marks or business names (whether registered or unregistered), confidential information and copyright; and
- the material does not infringe any applicable laws including, but not limited to, the Australian Competition and Consumer Laws.
You agree to Cancer Council and its assignees and licensees using photographs, images, film, audio recordings, text, or artwork taken of you and materials provided by you (either complete or in part) for any purpose (including publicity, merchandising, editorial, education, fundraising) in any country and in any type of media without qualification (e.g. newspapers, magazines, social media, other print publications, radio and television broadcasts, websites, webinars, podcasts and vodcasts) and in perpetuity. You agree to the use of your name in conjunction with any photographs, images, film or audio recordings of or quotes from you . You also agree that the photographs, images, film, audio recordings, text or artwork taken of you and materials provided by you may be used by third party media organisations in connection with the reporting of Relay For Life.
Shipping and delivery
Cancer Council will distribute any merchandise purchased as part of your registration either at the Relay For Life you have registered for, at an Information Session about your Relay For Life prior to the event, or by post. Should you have any queries please contact your local Cancer Council office for assistance.
Pandemic and Communicable Disease Health Management
You agree to adhere to all public health rules and regulations notified to you by your local, state or federal Government, other regulatory body or the Relay For Life event venue.
If you are registering for Relay For Life on behalf of a group, as the team captain, you are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government (including a government health department) for the purposes of contact tracing, you must:
- make the contact details of your group available to the Government (if you have the consent of each group member to do so); or
- contact each member of your group, and request that they provide their contact details to the Government directly.
All attendees in your group, including yourself, must commit to stopping the spread of COVID-19. If at the time of the Relay For Life event, either you or any other members of your group are feeling unwell or are subject to a self-quarantine or self-isolation period, you agree not to attend the event.

Participation by children under 15 years (NSW participants only)
The Event Period is the period in which any fundraising activity associated with the event takes place, including participation in the Event itself.
To participate in the Event, children under 15 years of age must:
- a) be at least 8 years of age at the time of registration
- b) have the explicit consent of their parent or guardian to participate at the time of registration
- c) be accompanied/supervised by their parent or guardian (the Supervisor) during the Event Period and any associated fundraising activities
- d) only participate
- for less than 4 hours on a school day;
- for less than 6 hours on a non-school day;
- up to 8:30pm on a non-school day when the following day is a school day;
- no more than to five days in a week;
- after 6.30am or sunrise, whichever is the later; and
- up until sunset or 6pm, whichever is the earlier.
The Supervisor must ensure that during the Event Period:
- a) they maintain ongoing contact and proximity to the child appropriate to the child’s age;
- b) the child is provided with appropriate food and water or other nutritious drink;
- c) the child is adequately clothed and protected for the weather conditions;
- d) the child does not enter a private dwelling if soliciting door-to-door;
- e) the child does not solicit from a person in a motor vehicle; and
- f) they accompany the child home after the Event, unless the child is more than 12 years or age

- neither Cancer Council nor any Relay For Life sponsor or organiser (nor any of their directors, officers, employees, volunteers, agents and representatives) will be liable to you, or any other person in contract, tort (including negligence) or otherwise for any loss, damage, cost or expense of any kind (including direct, indirect or consequential losses, damages, costs and expenses) suffered or incurred by you, or any other person in connection with Relay For Life; and
- in any circumstances where the above exclusions (or any of them) are held by a court to be ineffective or unenforceable for any reason whatsoever, Cancer Council's liability to you and to any other person is limited (at its option) to resupplying, repairing or replacing the service to you or the payment of the cost of supplying the service to you again.
Refunds Policy
Registration payments and sponsorships of participants are not refundable for any reason. If you are unable or unwilling to participate in Relay For Life, or if the Relay For Life is modified or terminated for any reason, registration payments will be deemed to be donations to Cancer Council for which a tax-deductible receipt will be issued upon request. However, Cancer Council is willing to consider requests to transfer registration fees to future events on a case-by-case basis. Should you have made an error whilst registering or donating or wish to request a transfer to a future event please contact your local Cancer Council office for assistance.
Public Venue and Persons Giving Directions
Relay For Life is a public event held on premises or property made available for community events. As such, the agreement to participate means that you also agree to be bound by the rules and regulations that may apply to the premises or property where the Relay For Life is to be held. You also agree to follow the directions of anyone authorised to give directions whilst you are on the said premises or property. This includes directions not to participate, or to leave the premises or property where Relay For Life is held.
Behaviour
You agree to show respect and consideration for other participants in the event. You agree to abide by the venue rules concerning activities, coarse language, privacy, and noise. You acknowledge and agree that Relay For Life is a non-smoking event. You must obey all applicable laws at all time while participating in Relay For Life.
You also agree that you will abide by the decision of the local organisers of Relay For Life about whether alcohol is permitted to be consumed at the venue. You also agree that if alcohol is permitted, that you will not cause, permit or allow any such alcohol to be supplied to any minor. You acknowledge that Relay For Life is an animal free event, except for animals that are companions for people with visual impairments.
You acknowledge that Relay For Life is an event that may involve minors. You warrant that you/ are not a person recorded on the Australian National Child Offender Register.
Media Consent and Provision of Materials
You acknowledge that in the course of Relay For Life, photographs, images, film or audio recordings may be taken of you, either alone or with others. If you post photographs, images, film, audio recordings, text or artwork (“materials”) on social media, share that content with Cancer Council using hashtags or tag Cancer Council in the post, or otherwise provide any materials to Cancer Council, you will ensure that:
- you own the intellectual property in those materials or have the permission of the owner of the intellectual property for Cancer Council (and its assignees and licensees) to use such items;
- the material is not defamatory or a malicious falsehood in relation to any product, service, person or corporation;
- the material is not a ‘passing off’ of any product or service and does not constitute unfair competition;
- the material does not infringe any intellectual property right including, but not limited to, trademarks, service marks or business names (whether registered or unregistered), confidential information and copyright; and
- the material does not infringe any applicable laws including, but not limited to, the Australian Competition and Consumer Laws.
You agree to Cancer Council and its assignees and licensees using photographs, images, film, audio recordings, text, or artwork taken of you and materials provided by you (either complete or in part) for any purpose (including publicity, merchandising, editorial, education, fundraising) in any country and in any type of media without qualification (e.g. newspapers, magazines, social media, other print publications, radio and television broadcasts, websites, webinars, podcasts and vodcasts) and in perpetuity. You agree to the use of your name in conjunction with any photographs, images, film or audio recordings of or quotes from you . You also agree that the photographs, images, film, audio recordings, text or artwork taken of you and materials provided by you may be used by third party media organisations in connection with the reporting of Relay For Life.
Shipping and delivery
Cancer Council will distribute any merchandise purchased as part of your registration either at the Relay For Life you have registered for, at an Information Session about your Relay For Life prior to the event, or by post. Should you have any queries please contact your local Cancer Council office for assistance.
Pandemic and Communicable Disease Health Management
You agree to adhere to all public health rules and regulations notified to you by your local, state or federal Government, other regulatory body or the Relay For Life event venue.
If you are registering for Relay For Life on behalf of a group, as the team captain, you are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government (including a government health department) for the purposes of contact tracing, you must:
- make the contact details of your group available to the Government (if you have the consent of each group member to do so); or
- contact each member of your group, and request that they provide their contact details to the Government directly.
All attendees in your group, including yourself, must commit to stopping the spread of COVID-19. If at the time of the Relay For Life event, either you or any other members of your group are feeling unwell or are subject to a self-quarantine or self-isolation period, you agree not to attend the event.

Mini RFL Participation Terms and Conditions
In consideration of this registration being accepted and my being permitted to participate in the Event, I agree to the following, intending to be legally bound for myself and my heirs, executors and administrators.
Cancer Council Queensland is the charitable fundraising recipient of the Event. Cancer Council Queensland has a limited administrative role assisting the Organiser with participant registrations, fundraising activities and donations. Cancer Council Queensland has no responsibility for, nor control over, the preparation, organisation, operation or supervision of the Event.
Event means the event or activity for which you are registering and any related events or activities that take place prior to or after the main event.
Organiser means the people or organisation that is organising the Event.
- I understand and agree that I participate in the Event at my own risk, and that I am responsible for ensuring my own health and safety while participating in the Event.
- I acknowledge and agree that sporting activities and similar leisure time pursuits, such as the Event, are inherently dangerous and my participation in the Event may involve a significant degree of physical exertion and risk, including the risk of physical injury or even death, and I voluntarily agree to assume those risks. I accept that the Organiser and Cancer Council Queensland have not undertaken any assessment of my ability to participate, and I am solely responsible for assessing my level of fitness and ability to participate.
- I warrant, as a condition of entering the Event, that I have sufficiently trained and I am sufficiently physically fit for the Event and I am not aware of any illness, injury or any other circumstances which may cause or contribute to personal injury, death and/or property damage to me or anyone else. I agree to consult with my medical practitioner prior to the Event if I am in any doubt as to my fitness and whether to participate.
- I consent to receiving any medical assistance which is considered appropriate by officials or medical staff at the Event. If I am required to be transported to a medical facility such as a hospital for further assistance, I agree to pay any costs associated with such transportation and further medical assistance.
- I agree to obey all applicable laws and regulations (including public health rules) during the Event, and agree to follow the directions of the Organiser, emergency support staff or any law enforcement agency during the Event.
- I acknowledge and agree that I may be disqualified and/or removed from the Event if I breach (or am reasonably suspected of breaching) these terms and conditions or if my behavior is dangerous, offensive or abusive.
- I consent to the Organiser or Cancer Council Queensland providing personal and/or health information collected from me to public health authorities where they are required by law to do so.
- I agree to undertake a reasonable assessment of my own health status and agree not to attend or participate in the Event if I:
- have COVID-19 or I am experiencing cold or flu symptoms; or
- am required to be in either isolation or quarantine.
- I acknowledge and agree that:
- I am solely responsible for my personal possessions during the Event;
- the Organisers and Cancer Council Queensland are not responsible for any loss, theft or damage to personal belongings; and
- any vehicles are parked at the owner’s own risk.
- To the fullest extent permitted by law, I forever release all persons and organisations associated directly or indirectly with the conduct of the Event (Released Entities) from all claims, demands and proceedings arising out of my participation in the Event and indemnify each of the Released Entities against all loss, cost, damage and liability (including liability for their negligence and the negligence of others) arising out of or connected with my participation in the Event. This release and indemnity shall extend to and include:
- The Organisers, Cancer Council Queensland, sponsors, volunteers or any other entity associated with the organisation of the Event, including Event medical and paramedical personnel;
- the owners, licensees and occupiers of land upon which any part of the Event is conducted;
- any statutory body or local authority having control over any land upon which any part of the Event is conducted; and
- the related bodies corporate, agents, officers, employees, members and/or contractors of each person or entity mentioned in paragraphs (a)-(c) above.
- Section 139A of the Competition and Consumer Act 2010 (Cth) affects the extent to which a contract for the supply of recreational services can exclude, restrict or modify: (a) application of, (b) rights under, or (c) liability for failure to comply with, certain consumer guarantees relating to the supply of services that are otherwise implied in consumer transactions by the Australian Consumer Law.
- Accordingly, to the extent permitted by law, I agree that each of the guarantees in Part 3-2, Division 1, Subdivision B of the Australian Consumer Law in respect of recreational services provided by or on behalf of the Organiser, Cancer Council Queensland or any Released Entity, is excluded in respect of liability for the events and circumstances set out in s139A(3) of the Competition and Consumer Act 2010 (Cth).
- Similarly, to the extent permitted by law, I also agree that any liability of the Organiser, Cancer Council Queensland or any Released Entity in respect of any of the guarantees referred to in clause 12 above is excluded in respect of the events and circumstances set out in s139A(3) of the Competition and Consumer Act 2010 (Cth).
- I agree and consent to the publication, use and marketing by the Organiser or Cancer Council Queensland and any of its assignees or licensees from time to time of my name, image and/or performance in the Event for any purpose (including publicity, merchandising and fundraising) by any form of media (e.g. newspapers, magazines, other print publications, radio and television broadcasts, websites, webinars, podcasts and vodcasts) in perpetuity and without compensation. If you do not want the Organiser or Cancer Council Queensland to use your name, image or performance in the Event for this purpose please contact us by email at I acknowledge and agree that such images are owned by Cancer Council Queensland. Cancer Council Queensland is not responsible for photographs and images taken by persons who are not an official representative of Cancer Council Queensland.

- If the Event is modified or terminated for any reason, you may request Cancer Council Queensland for a refund of your registration payment (if any) or to transfer registration fees to a future event. Alternatively, you may request your registration payment to be deemed a donation to Cancer Council Queensland, for which a tax-deductible receipt will be issued.
- If any provision in this document is unenforceable, illegal or void, then the parties agree that the provision must be read down the minimum necessary to allow it to be enforceable whilst preserving as close as is possible the purpose of the provision. If the provision cannot be read down, it is severed, and the rest of this document remains in force.
- This agreement constitutes the entire agreement between you, the Organiser and Cancer Council Queensland in respect of its subject matter and supersedes any prior agreement or understanding in relation to anything connected with its subject matter. To the extent of any inconsistency between this agreement and any other document you agree to at the Event, this agreement prevails.
- These terms and conditions are subject to the laws of Queensland, Australia. The Organiser, Cancer Council Queensland and you submit to the exclusive jurisdiction of the courts located in Queensland, Australia and the courts of appeal therefrom for the resolution of any dispute under these terms or concerning the Event.
- You certify that you are 18 years of age or older, and have read this document and understand and accept these terms and conditions. If you are under the age of 18, your parent or legal guardian certifies that they have read this document and understand and accept these terms and conditions. The Organiser and Cancer Council Queensland is entitled to assume the participant has complied with this clause and neither the Organiser nor Cancer Council Queensland are liable for any failure to obtain a parent or guardian's consent in respect of any participant under the age of 18.
- By completing the registration or participating in the Event, you accept these terms and conditions.

All participants in Relay For Life must accept these terms and conditions (“Terms and Conditions”) prior to their participation in Relay For Life. If you are under the age of 18, you must ensure that these Terms and Conditions are accepted by your parent or guardian on your behalf. By participating in the event you are also accepting the Fundraising Guidelines that apply in the State or Territory in which you are conducting your fundraising event; the Privacy Collection Statement; and any other documents provided to you in your welcome pack, and you agree to comply with them. Where relevant these Terms and Conditions will also apply to spectators and visitors at Relay For Life events and to donors and supporters of participants.
Definitions and Interpretation
“Relay For Life” includes not only the Relay For Life event, but all other activities relating to Relay For Life, whether occurring before, during or after the Relay For Life event, and whether organised by Cancer Council or any other person.
“Cancer Council”, “we”, “us” or “our” means the Cancer Council in the State or Territory in which you are participating in Relay For Life. Full details of Cancer Council Australia’s State and Territory members are available here: https://www.cancer.org.au/about-us/about-cancer-council.
“You” means all adult participants, all Youth Participants and any parent or guardian accepting these Terms and Conditions on behalf of a Youth Participant.
“Youth Participants” means participants under the age of 18.
If any of part of these Terms and Conditions is unenforceable, illegal or void, then you agree that that part must be read down the minimum necessary to allow it to be enforceable whilst preserving as close as is possible the purpose of that part. If that part cannot be read down, it is severed, and the rest of these Terms and Conditions remain in force.
Risk Notice and Voluntary Assumption of Risk
You understand and agree that you participate in Relay For Life at your own risk.
Relay For Life is an event that involves the inherent risks of harm associated with physical exertion. Some of those risks include injury due to slippery or uneven surfaces, obstacles, trip hazards, overcrowding, collision with objects or people and the effects of heat, cold, dehydration and exhaustion. In rainy, windy or other inclement weather conditions, tents, marquees or other structures may collapse or become unsecured from the ground, potentially resulting in injury. Further risks may be associated with parts of Relay For Life that may occur at night.
The above is not an exhaustive list of all risks inherent in your participation in Relay For Life. There may be risks that are not known or reasonably foreseeable at this time.
Cancer Council recommends that you consult a doctor before participating in Relay For Life, particularly if you have ever experienced a heart condition, stroke, unexplained chest pains, faintness, dizziness, shortness of breath, severe asthma, diabetes, muscle, joint or bone problems or any other medical conditions that may make it dangerous for you to participate in Relay For Life. Regardless of whether you have consulted a doctor, you agree that you are aware of the risks involved and you voluntarily assume those risks (including any arising from the negligence of Cancer Council).
You warrant that you have no known medical conditions or disabilities that may be incompatible with your safe participation in Relay For Life. You warrant that you are in proper physical and mental condition to participate in Relay For Life. You consent to medical care and transportation in order to obtain treatment in the event of injury to your during the event, as volunteers or medical professionals may deem appropriate. You understand that these Terms and Conditions extend to full release and exclusion for any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury to me.
You understand that Cancer Council has obtained no personal accident insurance or any other insurance covering your participation in Relay For Life and it is your responsibility to obtain any and all insurance which is appropriate for that purpose.
You acknowledge that during Relay For Life both your person and your property shall be at your own risk. You understand and accept that the organisers and Cancer Council are not responsible for any loss or damage to personal belongings and that vehicles are parked at the owner’s own risk.
You understand that Cancer Council will not supervise Youth Participants and that Youth Participants must arrange to be supervised by an adult.
Indemnity
You will indemnify, keep indemnified and hold harmless Cancer Council and all Relay For Life sponsors and organisers, as well as their officers, employees, volunteers, agents and representatives, from any and all loss, damage, cost or expense in connection any claim arising from your participation in or involvement with Relay For Life or any breach of these Terms and Conditions by you; and publication or supply of any materials (as defined in the Media Consent and Provision of Materials clause below) by you.
Release and Exclusion of Cancer Council's Liability
To the maximum extent permitted by law:
- you fully and irrevocably exclude and release Cancer Council and all Relay For Life sponsors and organisers, as well as their directors, officers, employees, volunteers, agents and representatives, from all liability for any loss, damage, cost or expense (whether in negligence, contract, under statute or otherwise) suffered by you as a consequence of my involvement in Relay For Life, including in relation to death and personal injury;
- all conditions, warranties, guarantees, rights, remedies, liabilities or other terms implied or conferred by statute, custom, or the general law that impose any liability or obligation on Cancer Council or Relay For Life sponsors or organisers (or their directors, officers, employees, volunteers, agents and representatives) are excluded (including consumer guarantees to the extent such exclusions are permitted under the law);
- neither Cancer Council nor any Relay For Life sponsor or organiser (nor any of their directors, officers, employees, volunteers, agents and representatives) will be liable to you, or any other person in contract, tort (including negligence) or otherwise for any loss, damage, cost or expense of any kind (including direct, indirect or consequential losses, damages, costs and expenses) suffered or incurred by you, or any other person in connection with Relay For Life; and
- in any circumstances where the above exclusions (or any of them) are held by a court to be ineffective or unenforceable for any reason whatsoever, Cancer Council's liability to you and to any other person is limited (at its option) to resupplying, repairing or replacing the service to you or the payment of the cost of supplying the service to you again.

Participation by children under 17 years
The Event Period is the period in which any fundraising activity associated with the event takes place, including participation in the Event itself.
To participate in the Event, children under 17 years of age must:
- ) have the explicit consent of their parent or guardian to participate at the time of registration
- be accompanied/supervised by their parent or guardian (the Supervisor) during the Event Period and any associated fundraising activities
- only participate
- for less than 4 hours on a school day;
- for less than 6 hours on a non-school day;
- up to 8:30pm on a non-school day when the following day is a school day;
- no more than to five days in a week;
- after 6.30am or sunrise, whichever is the later; and
- up until sunset or 6pm, whichever is the earlier.
The Supervisor must ensure that during the Event Period:
- a) they maintain ongoing contact and proximity to the child appropriate to the child’s age;
- b) the child is provided with appropriate food and water or other nutritious drink;
- c) the child is adequately clothed and protected for the weather conditions;
- d) the child does not enter a private dwelling if soliciting door-to-door;
- e) the child does not solicit from a person in a motor vehicle; and
- f) they accompany the child home after the Event, unless the child is more than 12 years or age
Authorised Fundraiser ID Badge
There have been some important changes to South Australian law in regards to how you represent Cancer Council SA as a Fundraiser when collecting donations of goods, services or money from people you don’t know (unsolicited) in the community:
Name tag:
Upon registration, each registered fundraiser will receive, via email, a Letter of Authority and Fundraising ID Badge.
- Please cut out and wear your unique identification name badge if you are sourcing donations from people you don't know
- The name tag must be visible to the public at all times
- You might like to laminate or put in a plastic name tag holder for safe keeping and to ensure it is not lost.

You understand that Cancer Council has obtained no personal accident insurance or any other insurance covering your participation in Relay For Life and it is your responsibility to obtain any and all insurance which is appropriate for that purpose.
You acknowledge that during Relay For Life both your person and your property shall be at your own risk. You understand and accept that the organisers and Cancer Council are not responsible for any loss or damage to personal belongings and that vehicles are parked at the owner’s own risk.
You understand that Cancer Council will not supervise Youth Participants and that Youth Participants must arrange to be supervised by an adult.
Indemnity
You will indemnify, keep indemnified and hold harmless Cancer Council and all Relay For Life sponsors and organisers, as well as their officers, employees, volunteers, agents and representatives, from any and all loss, damage, cost or expense in connection any claim arising from your participation in or involvement with Relay For Life or any breach of these Terms and Conditions by you; and publication or supply of any materials (as defined in the Media Consent and Provision of Materials clause below) by you.
Release and Exclusion of Cancer Council's Liability
To the maximum extent permitted by law:
- you fully and irrevocably exclude and release Cancer Council and all Relay For Life sponsors and organisers, as well as their directors, officers, employees, volunteers, agents and representatives, from all liability for any loss, damage, cost or expense (whether in negligence, contract, under statute or otherwise) suffered by you as a consequence of my involvement in Relay For Life, including in relation to death and personal injury;
- all conditions, warranties, guarantees, rights, remedies, liabilities or other terms implied or conferred by statute, custom, or the general law that impose any liability or obligation on Cancer Council or Relay For Life sponsors or organisers (or their directors, officers, employees, volunteers, agents and representatives) are excluded (including consumer guarantees to the extent such exclusions are permitted under the law);
- neither Cancer Council nor any Relay For Life sponsor or organiser (nor any of their directors, officers, employees, volunteers, agents and representatives) will be liable to you, or any other person in contract, tort (including negligence) or otherwise for any loss, damage, cost or expense of any kind (including direct, indirect or consequential losses, damages, costs and expenses) suffered or incurred by you, or any other person in connection with Relay For Life; and

Refunds Policy
Registration payments and sponsorships of participants are not refundable for any reason. If you are unable or unwilling to participate in Relay For Life, or if the Relay For Life is modified or terminated for any reason, registration payments will be deemed to be donations to Cancer Council for which a tax-deductible receipt will be issued upon request. However, Cancer Council is willing to consider requests to transfer registration fees to future events on a case-by-case basis. Should you have made an error whilst registering or donating or wish to request a transfer to a future event please contact your local Cancer Council office for assistance.
Public Venue and Persons Giving Directions
Relay For Life is a public event held on premises or property made available for community events. As such, the agreement to participate means that you also agree to be bound by the rules and regulations that may apply to the premises or property where the Relay For Life is to be held. You also agree to follow the directions of anyone authorised to give directions whilst you are on the said premises or property. This includes directions not to participate, or to leave the premises or property where Relay For Life is held.
Behaviour
You agree to show respect and consideration for other participants in the event. You agree to abide by the venue rules concerning activities, coarse language, privacy, and noise. You acknowledge and agree that Relay For Life is a non-smoking event. You must obey all applicable laws at all time while participating in Relay For Life.
You also agree that you will abide by the decision of the local organisers of Relay For Life about whether alcohol is permitted to be consumed at the venue. You also agree that if alcohol is permitted, that you will not cause, permit or allow any such alcohol to be supplied to any minor. You acknowledge that Relay For Life is an animal free event, except for animals that are companions for people with visual impairments.
You acknowledge that Relay For Life is an event that may involve minors. You warrant that you/ are not a person recorded on the Australian National Child Offender Register.
Media Consent and Provision of Materials
You acknowledge that in the course of Relay For Life, photographs, images, film or audio recordings may be taken of you, either alone or with others. If you post photographs, images, film, audio recordings, text or artwork (“materials”) on social media, share that content with Cancer Council using hashtags or tag Cancer Council in the post, or otherwise provide any materials to Cancer Council, you will ensure that:
- you own the intellectual property in those materials or have the permission of the owner of the intellectual property for Cancer Council (and its assignees and licensees) to use such items;
- the material is not defamatory or a malicious falsehood in relation to any product, service, person or corporation;
- the material is not a ‘passing off’ of any product or service and does not constitute unfair competition;
- the material does not infringe any intellectual property right including, but not limited to, trademarks, service marks or business names (whether registered or unregistered), confidential information and copyright; and
- the material does not infringe any applicable laws including, but not limited to, the Australian Competition and Consumer Laws.
You agree to Cancer Council and its assignees and licensees using photographs, images, film, audio recordings, text, or artwork taken of you and materials provided by you (either complete or in part) for any purpose (including publicity, merchandising, editorial, education, fundraising) in any country and in any type of media without qualification (e.g. newspapers, magazines, social media, other print publications, radio and television broadcasts, websites, webinars, podcasts and vodcasts) and in perpetuity. You agree to the use of your name in conjunction with any photographs, images, film or audio recordings of or quotes from you . You also agree that the photographs, images, film, audio recordings, text or artwork taken of you and materials provided by you may be used by third party media organisations in connection with the reporting of Relay For Life.
Shipping and delivery
Cancer Council will distribute any merchandise purchased as part of your registration either at the Relay For Life you have registered for, at an Information Session about your Relay For Life prior to the event, or by post. Should you have any queries please contact your local Cancer Council office for assistance.
Pandemic and Communicable Disease Health Management
You agree to adhere to all public health rules and regulations notified to you by your local, state or federal Government, other regulatory body or the Relay For Life event venue.
If you are registering for Relay For Life on behalf of a group, as the team captain, you are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government (including a government health department) for the purposes of contact tracing, you must:
- make the contact details of your group available to the Government (if you have the consent of each group member to do so); or
- contact each member of your group, and request that they provide their contact details to the Government directly.
All attendees in your group, including yourself, must commit to stopping the spread of COVID-19. If at the time of the Relay For Life event, either you or any other members of your group are feeling unwell or are subject to a self-quarantine or self-isolation period, you agree not to attend the event.
Fundraising and the Law
Basic obligations of the Charities Act which you as a Community Fundraiser must adhere to are:
- Money raised and the details of your actual income and expenditure must be returned to CCT within four weeks of the fundraiser/event.
- The fundraiser/event must meet requirements of relevant laws and regulations. Please contact the Community Fundraising Officer in your region (Hobart, Launceston or Devonport) if you need direction or guidance in this area.
- The financial aspects, fundraising, raffles, record keeping and management of the fundraiser/event are the responsibility of the Community Fundraiser, and as a result, the Community Fundraiser must comply with the Charities Act (for more information please go to Consumer, Building and Occupational Services, Tasmania; https://www.cbos.tas.gov.au/topics/clubs-fundraising/charities

All participants in Relay For Life must accept these terms and conditions (“Terms and Conditions”) prior to their participation in Relay For Life. If you are under the age of 18, you must ensure that these Terms and Conditions are accepted by your parent or guardian on your behalf. By participating in the event you are also accepting the Fundraising Guidelines that apply in the State or Territory in which you are conducting your fundraising event; the Privacy Collection Statement; and any other documents provided to you in your welcome pack, and you agree to comply with them. Where relevant these Terms and Conditions will also apply to spectators and visitors at Relay For Life events and to donors and supporters of participants.
Definitions and Interpretation
“Relay For Life” includes not only the Relay For Life event, but all other activities relating to Relay For Life, whether occurring before, during or after the Relay For Life event, and whether organised by Cancer Council or any other person.

“You” means all adult participants, all Youth Participants and any parent or guardian accepting these Terms and Conditions on behalf of a Youth Participant.

Refunds Policy
We recognise that we are operating in unique circumstances at the moment. With that in mind, registered participants will have the following options regarding refunds:
- If you are unable or unwilling to participate in Relay For Life, or if the Relay For Life is modified or terminated for any reason (not COVID related), registration payments will be transferred to the new date in the future (this will be the default position and will happen automatically if we need to move an event date) or can be deemed a donation at your request
- Should a participant have COVID-19 like symptoms, have COVID-19 or be a close contact of a COVID-19 case, we encourage you to be responsible and not attend the event. If you are affected in these circumstances or a government health order prevents you from attending, a refund of registration fees can be made on request (less a $2 processing fee).
To process a refund in this situation please email relayforlife@cancervic.org.au prior to the start of your event. - If the event is postponed or cancelled due to COVID-19 or restrictions placed by the government prevent the staging of the event and entrants are not able to take part, you can choose to:
*Transfer your registration to the new date (this will be the default position and will happen automatically if we do not hear from you)
*Donate your registration fee to Cancer Council or
*Request a refund. In this instance, please email relayforlife@cancervic.org.au with details of the postponed/cancelled event.

You acknowledge that Relay For Life is an event that may involve minors. You warrant that you/ are not a person recorded on the Australian National Child Offender Register.
Media Consent and Provision of Materials
You acknowledge that in the course of Relay For Life, photographs, images, film or audio recordings may be taken of you, either alone or with others. If you post photographs, images, film, audio recordings, text or artwork (“materials”) on social media, share that content with Cancer Council using hashtags or tag Cancer Council in the post, or otherwise provide any materials to Cancer Council, you will ensure that:
- you own the intellectual property in those materials or have the permission of the owner of the intellectual property for Cancer Council (and its assignees and licensees) to use such items;
- the material is not defamatory or a malicious falsehood in relation to any product, service, person or corporation;
- the material is not a ‘passing off’ of any product or service and does not constitute unfair competition;
- the material does not infringe any intellectual property right including, but not limited to, trademarks, service marks or business names (whether registered or unregistered), confidential information and copyright; and
- the material does not infringe any applicable laws including, but not limited to, the Australian Competition and Consumer Laws.
You agree to Cancer Council and its assignees and licensees using photographs, images, film, audio recordings, text, or artwork taken of you and materials provided by you (either complete or in part) for any purpose (including publicity, merchandising, editorial, education, fundraising) in any country and in any type of media without qualification (e.g. newspapers, magazines, social media, other print publications, radio and television broadcasts, websites, webinars, podcasts and vodcasts) and in perpetuity. You agree to the use of your name in conjunction with any photographs, images, film or audio recordings of or quotes from you . You also agree that the photographs, images, film, audio recordings, text or artwork taken of you and materials provided by you may be used by third party media organisations in connection with the reporting of Relay For Life.
Shipping and delivery
Cancer Council will distribute any merchandise purchased as part of your registration either at the Relay For Life you have registered for, at an Information Session about your Relay For Life prior to the event, or by post. Should you have any queries please contact your local Cancer Council office for assistance.
Pandemic and Communicable Disease Health Management
You agree to adhere to all public health rules and regulations notified to you by your local, state or federal Government, other regulatory body or the Relay For Life event venue.
If you are registering for Relay For Life on behalf of a group, as the team captain, you are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government (including a government health department) for the purposes of contact tracing, you must:
- make the contact details of your group available to the Government (if you have the consent of each group member to do so); or
- contact each member of your group, and request that they provide their contact details to the Government directly.
All attendees in your group, including yourself, must commit to stopping the spread of COVID-19. If at the time of the Relay For Life event, either you or any other members of your group are feeling unwell or are subject to a self-quarantine or self-isolation period, you agree not to attend the event.
Ticket and Fundraising PageRequirements
Every person attending a Relay for Life event as a participant is required to have a ticket. An account must be created to purchase any ticket/s. For privacy and security reasons an email address cannot be used for multiple accounts or fundraising pages.
Adult and youth participants opting to create a fundraising page must have a unique email address.
Please be aware that children under the age of 5 cannot fundraise, and therefore cannot create a fundraising page.

About Relay For Life
This website and service is provided by Cancer Council for the purposes of participating and or donating to Cancer Council via our Relay For Life events.

Refunds policy
Cancer Council do not offer refunds and our general policy is to treat your money as a donation. Should you have made an error whilst registering or donating please contact your local Cancer Council office for assistance.
Storage of credit card information
We use Secure Socket Layer (SSL) certificates, which is the industry standard for encrypting your credit card and debit card numbers, your name and address so that it cannot be viewed by any third party over the internet. Your financial information is encrypted on our servers and access to this information is restricted to authorised Cancer Council employees only. Cancer Council is compliant with the Payment Card Industry Data Security Standards (PCI DSS).
